Frequently asked questions

Why buy an already registered trade mark?

A new application requires a wait for a decision and may be refused. The OEPM gives an approximate processing period of 6 to 12 months, which may be longer if issues arise. Buying an already granted trade mark avoids starting that new application for the sign and scope acquired. Its validity, coverage and transfer terms are reviewed before the transaction is completed.

What is the value of a trade mark with its domain name?

Finding an appealing business name and a matching domain that is still available can be difficult. Every domain name is unique: registering a trade mark does not automatically reserve its web address. Starting with the domains associated with the offer avoids searching for another address or negotiating a separate purchase, and supports a consistent identity across the website and email.

Which assets and rights are included in the purchase?

You purchase the trade mark, the packaging proposal and the associated domain names listed in the asset page. The transaction specifies the registrations transferred, the design materials delivered and the change of domain ownership. Images show proposed applications; final packaging adaptations and production are agreed for each project.

How do I know whether a trade mark protects the product I want to launch?

The registered sign, territory and specific list of goods or services should be checked. The class alone does not define the full scope of protection, and images of possible ranges do not extend it.

What should be checked before completing the transaction?

Check ownership, current status, renewals, any encumbrances, licences or proceedings affecting the registration, as well as ownership of the domain. Review the documentation and transfer terms before completing a purchase.

How is a royalty-based licence structured?

The project, products, territory, term and exclusivity are assessed. The royalty calculation basis, reporting obligations and, where applicable, minimum payments and continuation terms are also negotiated. No financial terms are set in advance.

What can a registration do against similar later trade marks?

It may provide grounds for opposition where the legal requirements are met, including likelihood of confusion where applicable. The assessment depends on the sign as a whole and the goods or services; it does not automatically confer exclusivity over descriptive terms.
